Terms of Use

The Service is provided by Lynex Studio LLC ("Prevena", "we", "us"). These Terms constitute a legal agreement between you (the "User") and Prevena. You can contact us at info@prevena.app.

You must be at least 13 years old to use Prevena. Users aged 13-18 may use the Service only with the consent and supervision of a parent or legal guardian. We reserve the right to suspend or terminate any account that does not meet these age requirements.

You represent that you have the legal capacity to enter into a binding contract under the laws of your jurisdiction.

Prevena may require certain information to create an account. You are responsible for the security of the device linked to your account and for all activity that occurs through your account.

If you suspect unauthorised access to your account, notify us immediately at info@prevena.app.

Subject to your compliance with these Terms, Prevena grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to use the Service for your personal, non-commercial purposes.

You agree not to: reverse engineer, copy, modify, create derivative works from, rent, sell, or commercially redistribute the app; access the Service using automated tools (scrapers, bots); use the Service to create content that infringes others' rights, is unlawful, defamatory, harassing, or harmful; or attempt to circumvent the Service's security measures.

Some features of Prevena are available through a paid subscription. Subscription purchases are made through your device's app store (Apple App Store or Google Play) and are subject to that store's terms of use.

• Subscriptions renew automatically through the app store unless cancelled.
• Subscription fees are charged at the amount displayed in the app and on the store at the time of purchase.
• Cancellations take effect at the end of the current subscription period; no pro-rata refunds are provided.
• Refund requests are subject to the refund policy of the store where the purchase was made.
• Prices and plan features may change from time to time; you will be notified in advance of such changes.

You can manage and cancel your subscription at any time via your device's app store settings.

Prevena is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. All risk predictions, recommendations, AI responses and content in the app are provided for informational purposes only.

Always consult a qualified healthcare professional before making any decisions about your health. In case of emergency, call your local emergency number or visit the nearest medical facility. Prevena is not liable for any consequences arising from decisions made based on information in the app.

All content you create through the Service — including attack records, journal entries, chat messages, and profile information ("User Content") — belongs to you. You grant Prevena a worldwide, royalty-free, limited license to host, store, analyse (including for the prediction engine and chat feature) and render your content back to you so that we can provide the Service and generate reports for you.

You are responsible for the accuracy and legality of your User Content. You agree not to use the Service to create content that infringes others' rights, or is harmful, misleading, or unlawful.

Prevena uses AI models (Anthropic Claude) for its chat assistant and attack prediction features. AI outputs are probabilistic and may contain errors, omissions or misleading information. They do not constitute medical advice.

You have sole discretion over when and how to use AI features, and you are solely responsible for any decisions you make based on them. Details of AI data processing are provided in the Privacy Policy.

Other than User Content, the Prevena brand, logo, app design, user interface, text, imagery, source code and all software components are owned by Lynex Studio LLC and protected under applicable intellectual property laws.

Beyond the limited use license granted under these Terms, no rights to Prevena's intellectual property are transferred to you.

You agree not to do any of the following when using the Service:

• Violate applicable laws, regulations or third-party rights
• Create fake accounts on behalf of others or misrepresent your identity
• Use viruses, malicious code, or network attacks that could harm the Service, its servers or other users
• Attempt to circumvent the Service's security, authentication or metering mechanisms
• Use the Service to perform bulk data scraping via automated tools
• Harass, threaten or otherwise disturb other users
• Use the Service for commercial resale, white-labeling or agency-type purposes

Prevena relies on third-party services to operate (Supabase, Anthropic, Open-Meteo, Apple App Store, Google Play, Expo, Vercel). You may also be subject to their terms and privacy policies. Prevena is not responsible for the content or performance of third-party services.

If we determine that you have violated these Terms or applicable laws, we reserve the right to suspend or permanently terminate your account without prior notice.

You may terminate your account at any time from the Settings screen in the app or by sending an email to info@prevena.app. How your data is deleted after account termination is explained in the Privacy Policy.

To the maximum extent permitted by law, the Service is provided "as is" and "as available". Prevena makes no express or implied warranties that the Service will be uninterrupted, error-free, secure or fully suited to your needs.

The accuracy, completeness or fitness for a particular purpose of information, predictions or recommendations within the Service is not guaranteed.

To the maximum extent permitted by law, Prevena shall not be liable for any indirect, incidental, special, punitive or consequential damages (including loss of profits, loss of data or business interruption) arising from your use of the Service.

In any event, Prevena's total aggregate liability shall be limited to the greater of: (a) the total amount paid by you for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

You agree to indemnify, defend and hold harmless Prevena, its officers and employees from and against any and all claims, lawsuits, damages, costs (including attorneys' fees) and losses arising from your use of the Service, your User Content, or your violation of these Terms.

We may update these Terms from time to time. When significant changes are made, we will notify you in the app and update the "Last updated" date at the top of this page. Continuing to use the Service after such changes constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users using the Service from Turkey, mandatory provisions of Turkish consumer protection law remain reserved.

The courts and enforcement offices of the user's place of residence shall also have jurisdiction for disputes arising from these Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Prevena's failure to exercise any right under these Terms shall not be deemed a waiver of that right.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Prevena and supersede all prior oral or written understandings.
